Texas Bail Reform Bills Raise Concerns Over Pretrial Detention

Texas lawmakers are advancing two major bail reform proposals backed by Gov. Greg Abbott as part of his 2025 emergency priorities. Supporters claim the bills will improve public safety, while critics warn they could increase pretrial incarceration and worsen jail overcrowding.

Senate Bill 9 would ban personal bonds for some violent or repeat offenders and require elected judges—not magistrates—to set bail in serious cases.

Senate Joint Resolution 5 would amend the Texas Constitution to allow judges to deny bail entirely for certain violent crimes if prosecutors prove the accused is a threat or flight risk.

Critics argue the measures undermine due process and expand pretrial detention. Supporters, including victims’ families and advocacy groups like Crime Stoppers, say the reforms are needed to prevent repeat offenses.

Legal experts warn the changes could disproportionately impact marginalized communities and further entrench mass incarceration.
